INITIAL DEMOLITION NOTICE

SECTION 138(A) AND SCHEDULE 5A TO THE HOUSING ACT 1985 

It is the intention of the Council to demolish the property known as 9 Wordland Cross, Cheriton Fitzpaine, EX17 4JR (“the Premises”).

The reason for the demolition is proposed redevelopment of a site which comprises this property and 3 other neighbouring properties. The properties are of Woolaway PRC construction and are designated ‘defective’ property types under the Housing Act 1985 due to inherent defects, including a lack of concrete cover and the likelihood of corrosion of steel reinforcement leading to weakening of the structure. Furthermore, due to the nature of the property, it would be difficult to complete necessary upgrades to meet decarbonisation targets or to make the changes needed to deliver compliance with the Decent Homes Standard.

The Council intends to demolish the Premises within the next seven years from the date of this notice.

This notice will remain in force for a period of 7 years from the date of this notice unless revoked or otherwise terminated under the provisions of paragraph 3 of Schedule 5A of the Housing Act 1985 or extended.

Whilst this notice is in force, the Council will not be under any obligation to sell the freehold of any house or grant a lease as mentioned in section 138(1) of the Housing Act 1985 ("Right to Buy") in respect of any claim by a tenant to exercise the Right to Buy. The Right to Buy is accordingly suspended in respect of the Premises.

There may be a right to compensation under section 138C of the Housing Act 1985 in respect of certain expenditure incurred in relation to any existing Right to Buy claim that has been established prior to the date of the service of this Notice.
