Update (21 September 2018)

The Preliminary hearings into Policy J27 Land at Junction 27 and associated policies SP2 Higher Town, Sampford Peverell and TIV16 Blundells School have now concluded. The Inspector will clarify the situation in relation to these policies and how the Examination will then proceed in due course.

The Inspector has confirmed that the preliminary hearings into Policy J27 Land at Junction 27 and associated policies SP2 Higher Town, Sampford Peverell and TIV16 Blundells School, will take place on 20th and 21st September 2018.

After that, the Inspector will clarify the situation in relation to those policies, and how the Examination will then proceed.

The Inspector has issued revised documents for Matters and Issues (ID02a) and the Hearing Programme (ID03a) but is not inviting further hearing statements from the Council or other participants.

Update (29 May 2018)

The Planning Inspector submitted letter ID06 to Mid Devon District Council asking the Council to review the submitted Habitat Regulations Assessment and confirm the extent to which it is legally compliant in light of the recent judgement of the Court of Justice of the European Union in People over Wind, Peter Sweetman v Coillte Teoranta (Case C-323/17).

Update (27 April 2018)

The findings of the Independent Review of the Sustainability Appraisal Update 2017, associated documents and representations received in the period 28th February to 11th April 2018 have been submitted to the Inspector.

Update (28 February 2018)

Revised hearing dates to be set following public consultation on update to Sustainability Appraisal (SA).

An opportunity for public consultation on the findings of the independent review and proposed amendments to the Sustainability Appraisal will take place between 28th February and 11th April 2018. The proposed amendments add greater clarity to the Sustainability Appraisal and do not amend the content of the Mid Devon Local Plan Review (incorporating proposed modifications) that has already been submitted to the Planning Inspectorate for examination. Revised hearing dates will be set by the appointed Inspector following this period of consultation. For more information on the public consultation please click here 

Update (14 September 2017)

The Planning Inspector postponed the first Examination Hearings due to take place on the 26 and 27 September at the request of Mid Devon District Council.

Having reviewed the statements received by Examination Hearing participants and having taken legal advice, Mid Devon District Council requested an adjournment of the Local Plan Hearings. This adjournment provided the opportunity for the council to commission an independent report by consultants LUC to review the Sustainability Appraisal of proposed modifications made to Mid Devon Local Plan Review.

These Inspector-led hearings were to consider the proposed leisure, tourism and retail allocation at Junction 27 of the M5 motorway (policy J27) and the housing sites at Higher Town, Sampford Peverell (policy SP2) and at Blundell’s Road, Tiverton (policy TIV16).
